Click here to watch a short, entertaining video about their journey to the 21st century ... http://www.youtube.com/watch?v=bE9xEWMLCLMTerms and Conditions of the Guess Who’s Coming To Dinner Auction:THE THANKSGIVING HISTORY COMES HOME FOR THE HOLIDAYEXPERIENCE: The Thanksgiving History Comes Home for the Holiday Experience (the “Experience”) consists of two 17th century role playing interpreters (the “Interpreters”) – a Pilgrim and a Native American/Wampanoag – who will join you for your Thanksgiving meal at your home or such other location as you may choose. The Interpreters will be dressed in appropriate 17th century clothing and will interact with you, your guests and each other for the duration of the meal (not to exceed two hours), staying in character throughout. After two hours, or upon the serving of dessert, if earlier, the Interpreters will come out of character and will be available to answer questions for up to two additional hours. ELIGIBILITY: The Thanksgiving History Comes Home for the Holiday Experience Auction (the “Auction”) is open only to individuals that are legal residents of the United States who are at least 18 years of age at the time of entry, or United States legal business entities. The minimum bid is $5,000. By participating in the Auction, each bidder accepts the conditions stated in these Terms and Conditions and agrees to be bound by the results of the Auction and the decisions of Plimoth Plantation, Inc. (“Plimoth Plantation”). WINNING BIDDER OBLIGATIONS: The Auction will close at 16:21 pm EST on October 11, 2008. The bidder who has submitted the highest bid at that time (the “Winning Bidder”) shall pay for the full amount of their winning bid no later than October 23, 2008. The Winning Bidder shall notify Plimoth Plantation in writing no later than November 1, 2008 of the location (the “Location”), date and start time of the meal, such Location to be in the United States, such date to be no earlier than November 20, 2008 and no later than December 4, 2008, and such start time to be no earlier than 11:00 am and no later than 7:00 pm (local time). The Winning Bidder shall pay for coach-class round-trip airfare for the Interpreters from Logan International Airport in Boston, Massachusetts to the major airport closest to Location, except that ground transportation (for-hire sedan service) to and from the Location may be substituted for air travel if the Location is within 100 miles of Boston, Massachusetts. Winning Bidder shall pay for two nights hotel accommodations at a three star or equivalent hotel for the Interpreters, such hotel to be within 10 miles of the Location. If no such accommodations are available, the Winning Bidder and Plimoth Plantation shall mutually agree upon alternative accommodations. Winning Bidder shall be responsible for other incidental expenses reasonably incurred by the Interpreters, including, without limitation, ground transportation between the airport and the hotel, ground transportation between the hotel and the Location, and applicable fees and taxes. The Winning Bidder, at Winning Bidder’s own expense, shall provide each of the Interpreters with a meal substantially the same as the meal offered to the other guests at the Experience. The Interpreters shall not be responsible for bringing any food or drinks to the meal. If the Interpreters’ stay at the accommodations is extended due to any event beyond Plimoth Plantation’s and the Interpreters’ control, including, without limitation, adverse weather conditions, Winning Bidder shall be responsible for all costs incurred by the Interpreters and Plimoth Plantation in connection with such extension, including, without limitation, payment for an additional night or nights at such accommodations and airline change fees. Any and all payments to be paid by the Winning Bidder as described in this paragraph are not included in the Winning Bidder’s winning bid amount. As a condition to winning the Experience, the Winning Bidder must sign and return an Affidavit of Eligibility, Release of Liability and Publicity Release within ten (10) calendar days of receipt of such Affidavit and Release. In the event that the Winning Bidder fails to sign and return such Affidavit and Release within the specified time period, or if the Winning Bidder does not accept the Experience for any reason, including, without limitation, death or incapacity, Plimoth Plantation may offer the Experience to the Auction bidder who submitted the next-highest bid, provided, however, that if such alternative bidder is not identified with sufficient time for such bidder to accept the Experience or if such bidder does not accept the Experience for any reason, the Winning Bidder shall be responsible for paying the entire amount of the Winning Bidder’s submitted bid.OTHER TERMS AND CONDITIONS: Plimoth Plantation is not responsible for any incorrect or inaccurate information associated with or utilized in the Auction by any technical or human error which may occur in the processing of Auction bids. Plimoth Plantation assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Auction bids. If, for any reason, the Auction is not capable of running as planned, including tampering, unauthorized intervention, fraud, or any other causes beyond the control of Plimoth Plantation which affects the administration, security, fairness, integrity or proper conduct of the Auction, then Plimoth Plantation reserves the right at its sole discretion to cancel, terminate, modify or suspend the Auction.All issues concerning the rights and obligations of the bidder and Plimoth Plantation in connection with this Auction shall be governed by, and construed in accordance with, the laws of the Commonwealth of Massachusetts, without giving effect to any choice of law or conflict of law rules. Plimoth Plantation shall not be liable for any punitive, incidental or consequential damages or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
